What is the name of your state? COLORADO

Okay, I've been living in a townhome for about 3 months. My rent is for $825 a month and I haven't been late so far until recently because someone went into my account and took out money, causing my rent check to bounce. My landlord just called me today to let me know that my check came back insufficient funds and that's when I found out money was taken out of my account. My bank, Chase, is willing to investigate this and stated that they will issue a temporary credit to my account but it won't be until Monday.

I told my landlord this, and she refuses to wait until monday. She says that if I don't pay $855 (rent plus returned check fee) by today at 4pm, she will evict me. The problem is that I don't get off of work until 5:30pm, but she doesn't care, and I can't get $800 overnight like that.

My question is if she can really evict me if i don't pay her at 4pm today, or if it is possible to pay her on Monday? I really need some legal advice...

Thanks

Well what is the eviction process? Because according to her, she can evict me without written notice or anything, and I don't believe that.

When a Colorado Tenant Has Not Paid Rent

Before filing a suit in Colorado to evict a tenant for nonpayment of rent, the landlord must post a written, signed demand giving the tenant the choice of either paying the past due rent or moving out within three days. In computing the period of days the first day is excluded. Therefore, the three day time period begins the day following the posting. The notice must be posted in a conspicuous place on the premises. After the notice has been posted and if the tenant has not paid the rent or moved out within three days, the landlord need not accept the rent and may file an eviction suit at your local Justice Center. The time begins running whether or not the tenant discovers it posted. Also the time continues to run regardless if it is a Saturday, a Sunday, or a holiday. The tenant's legal right to this three day notice prior to eviction for nonpayment of rent cannot be taken away by the language in a lease.
