I own a duplex in Culver City, California. I am going to give one of my tenants a Notice to Vacate. He has signed yearly leases for two years, but his last lease ended May 31, 2009, without a new lease being signed. It is my understanding that in California his lease is automatically granted a 6-month extension. Therefore, his automatic extension will end Nov. 30 of this year. I know that he is entitled to 60 days notice as he has lived there more than one year. (He has become a real nuisance for the neighbors, and, in fairness to them, I cannot continue renting to him.)

Here is my question: Must the Notice to Vacate be 60 days from December 1, or can it be given on November 1, before the extension is up, as I want him out by December 31?

Thank you.

Gail will give a real dependable answer here but it is my guess that you are fine giving a November notice or all the way up to December 1 notice as long as you give them 60 days to vacate.
