late grandmothers assets

hi
my gran was with her partner for over 30 years , he was found to be cheating on her whilst my gran was terminally ill 5 years ago (2005). He left her in their jointly owned house and moved in wih this new lady. He was still paying the mortgage purly because of guily or he thought that he'd get all the house. At this point she served a severence of tenancy and changed her will to my mother. he carried on paying the mortgage for 5 years until she died(JAN2010). at the time of split (2005)there was 32k left on the mortgage with 7 .2years left. There is 2 years left on the mortgage which should be approx approx 14k. I was looking at statements from the bank and he has taken out 70K!!!! on the house therefore there is like 72k left on the mortgage. i spoke to him and he thinks that that 70k is her responsiblity to pay because he had to move out. but surely this money is not our responsiblity as he used this money to buy a house with his new wife! he is very deviant. i have no idea where i stand. i thought if the house is worth 120k he'd get half (60k), we'd get half (60k) and we'd give him half of the past 5 year mortgage (14k) and half of whats left (7k) and the 72k which he has taken out is hes responsibility to pay surely. but he thinks different? any help please!!!!!!!
 
In what state did they live?

As far as the re-fi, he had the right to do that, if he was legally married to her.

Now, if there was never a marriage, he might have a problem!
