Personal Bankruptcy Lawsuit and Ch13

My wife has been sued for a +25k credit card debt. I was not.

She has income from Soc Sec. and I have a full time job.

We are considering Ch13 bk. I also have seen where she can declare Ch13 separately.

If she declared Ch 13 would that stop lawsuit?

Yeah but she will still have to pay a portion of it back under the 13- Most of the time the bankruptcy courts want to no why she is filing and you are not ---the CC company can not take $$ from SSI and if you are not on the account they cant take $$ from you-- However they can garnish wage's that you are both on- so I would get your own account to put your $$ in it and ifthey garnish her account you she would have to appeal because the money came from SSI and they would have to release it back to her
