I sold a car on ebay, i had it listed with the correct mileage of 220k, a buyer emailed through ebay and asked if i would take cash for the vehicle. I said yes and he showed up that night to pay me cash. I still had a lien on the vehicle and he paid cash for the car and signed a bill of sale that i downloaded from the DMV. Also downloaded Release of Liability and had him fill it out. We paid off the loan the next day and had the Bank overnight the title which we signed and overnighted to the buyer. The Release of Liability was mailed to the DMV the same day. It is four months later now and i recieved a lawsuit that names me and this stranger that bought the car as Co-conspirators that committed fraud. Apparently the guy that bought my car rolled back the odometer and sold it for more than i had sold it to him for, he used the title i sent him and obviously crossed out the correct odometer reading of 227000 and very obviously drew in 74000. We have a copy of the title with the mileage from before we overnighted it. I did everything that the DMV says to do when selling a vehicle. Did i do anything wrong? Am i in anyway liable?
