My wife was working fulltime for a school district as a teacher. She was
notified in May verbally by her priciple that she would not have a position for
her due to other low performing schools closing. A senior teacher would get her position. School ended and she never received a Pink slip or any written notification or COBRA rights. In June we requested a written letter noting that she had lost her job, I needed this letter to get my wife on my insurance.
Thay advised us that she was still employed full time and that HR had not received any notification of her loosing her position. At this same time she was placed on as a substitute teacher. HR questioned how she was a sub and full time at the same time, but would not give us any written notice.
Because of this I cannot get my wife on my insurance and will have to wait
for the next open enrollement. I requested they provide Cobra to continue paying out of our pocket for my wife insurance. Again no she still on full time status. School began in August and my wife has no job. We notice that a pay check was deposited in our bank account from the school. We called them to find out why? After tons of calls and getting the run around, they realized no one had filled any paper work to HR. Now they want her last two pay checks back and to pay for the last 3 months of insurance coverage.
We tired many time to tell them that she was laid off, that we needed written notification to get her on my insurance, or we need to apply to COBRA, all were denid to us. It took us thru many phone calls to get someone to look into this. HR told my wife no one told us anything, but its not our problem its your principle that dropped the ball. Now they want to charge us back for everything. What is your advice for us?
