Layoff - Employee Rights

Help! I was recently laid-off from a home improvement manufacture on 9/23/2008 and I need some help. I have a couple of issues.

1) I have been employeed by a california manufacturer of home improvements for almost 5 years. Recently, I was convinced by the owner of the company to relocate my position from the retail sales division to the wholesales division. I was awarded a raise, and was announced as the national sales manager to the company and the clients. After the announcement I spoke with the owner and he stated during our meeting that I had a long carreer with the organization despite the recent re-hire of a retail sales manager. 2 Weeks later I was the target of a Lay-off. I know it is a long shot, but is there any legal action for that conduct, or is that just a an example of a poor business owner?

2) According to my signed compensation package, signed by myself and the president of the organization, I was compensated salary, vacation time and 2% of all gross sales. As of my lay-off, my former employer has paid the vacation, the salary, and is refusing to pay the commissions that I have earned. The commissions are for the months of July, August, through the 15th of September. The total commissions to be paid is an excess of 21,000 USD. I am also owed an expense re-embursment of approximately 800.00. PLease Help. What can I do to get those monies. Also is there any regulations by the state of California?

Unfortunately, nothing you can do for the first item. As far as item two, since we have not seen the contract, we cannot tell what laws apply to it. The best suggestion you can get is for you to have an experienced employment/labor attorney in your state take a look at the contract and evaluate what you should do next. Thank you for your advice. Just to follow up, I was hired as a full time employee and not a 1099 or independandt contractor. Where do I start my search for an attorney?
