Layoff

Hello, I have a situation. I started working for a company 10/18/10, I was progressing very well considering the poor training. January 7, 2011 my manager called me into the office and said that the company was slow and that they were doing cutback, "Today's your last day", as was many other employees throught the company. Now weeks prior, a couple of new employees were hired for the same position, as was the female that started with me, come to find out that the most recent hired, was a friend of the manager inwhich they both worked together at a company previously, as does many of the employees in this particular department. The company has what's called score cards and bonuses etc. are based accordingly, when the layoff happened, I was at the time number one throughout the company for my performance.

SWITCH;

I listened to headhpones, as does many of the companies employees, I was given a verbal warning for not hearing my phone ring(when it was the manager calling) just to tell me something or to call me to her office. I did comply, to EVERYTHING that was mentioned. Now she would tell me to turn my headphones down when there was no-one in fornt of me, no one behind me, no one to the right of me (In cubicles), she said that the small amount of static that was heard was or would disturb someone working, this was not a quite office atmosphere. I complied. I look up and she's giving me a written on the same thing that I just complied to. I refused to sign it because I presented the question to her and the HR representative who was present, "If I have complied to all that was asked of me for your verbal warning, why am I at a written"? Silence and the HR representative look at her and spoke for her because as I broke it down,the manager was acknowledging with a Yes head shake. She said that with my head phones on, no one felt comfortable approaching me, WOW! That wasn't what was said when I would talk to other employees.

Sitting to my left, across the row was another employee who noticed how the manager was constantly riding me about any and everything, and she mentioned to me that she had NOT done any other employee like that but myself and if I needed her to give a statement to just left her know, the manager slipped up and called me boy, inwhich (2) other employees heard it. Now I was laidoff and her friend was hired, my mangers superior they are all from the same previous company, and his plan is getting all of his former employees to this company.

My question; Being as though the company did layoff, (2) people were hired weeks prior to the layoff, how did the new employees get to stay and I get let go, I was already productive, well liked, never late but the managers friend gets to stay? I feel like I was discriminated against because of being a black male and I didn't work for the previous company, there's (17) employees in the department, (4) men 13 women, (1) black female from previous company, fyi.. please lend me some advise on which way to go.

Employers can fire and hire without excuse or reason.
If you believe you were discriminated against file a complaint with the EEOC.

I don't see any indicia of discrimination in your release, just choice.
 
It is LEGAL to make layoff decisions based on who is the manager's friend.

It is LEGAL to make layoff decisions based on who worked together at another company.
