Lease purchase nightmare

I am having so many problems! We signed an "Offer to Purchase and Contract" and the owner agreed to finance for one year. Here are some of the problems.
1 The house was listed as new, but it is not, it is a rehabbed modular
2 The roof was done poorly and is leaking along with other problems including a huge dip running along the entire length on the back, holes in the shingles, from where they roofed, took it off due to a poor job, and reroofed using some of the same shingles ( I have proof of this) nails with the plastic tabs on them that go in the paper all over the roof, nails popping up, no flashing or ridge vents
3 The ceiling texture is falling due to the leak, and the lack of priming
4 A bad GFI, we can't use several lights and outlets throughout the home, and have to run the fridge on a drop cord, which poses a fire hazard
5 The file at the Inspections office has a completely different house on the app for the building permit along with the specs, including serial, model numbers, sq footage, number of bedrooms, and items we don't have such as a fireplace and french doors, and now the Inspector refuses to help me, telling me that when he inspected it, it was the house in the file and it met the strict building codes.
6 The electricity had never been hooked up and never had temp power (proof of this also) yet it and the a/c passed inspection although it could not have worked due to a severed wire up in the attic from when the house was put together (proof of this) and there was no thermostat until the week before we moved in

There are so many other things, but we were told some things like the lack of thermostat were part of a punch out list. Now we have been lied to by the owner and we have a shady inspector who may not have even done the proper inspections. Our contract states that all systems including roofing and electrical etc, will be in working order with no need of immediate repair and if the owner refuses to repair them if they do we can terminate the contract and get our deposit back. I also read on another site that we can ask for a percentage of the money we pay every month due to the fact that we are paying to have use of everything in the home. We have been in contact with the owner with constant promises and appointments by his crew but they never show. Every month he says he is on it, and we have gotten our own estimates but he will not accept them.I have even called the companies on the permit that he says did the work, and either they say they didn't or that he owes them money or won't answer. We are fed up and I want to know if the inspector should be held accountable for some things and if these problems are something we should take legal action on.:mad:
 
You should have had the house inspected by an independent professional before signing the "offer to purchase and contract"... The first thing you need to do is check out the Landlord/Tenant Law in your state so you can see how you should proceed regarding filing a claim for maintenance and services that your landlord is responsible for. I would also check with an attorney on how you should proceed regarding the enforcement of this contract. Good Luck!

It states in the contract that we have a year to have the home inspected before closing, in September, as we have occupancy before closing. It also states that it has to appraise for the asking price, which it won't, and we have to give the owner the opportunity to make the repairs, which we have, and which he hasn't .Wouldn't it be a breach of contract if it says all systems(electrical, heating, a/c, plumbing, roofing, ceiling and walls) should be in working order, and they clearly aren't?
We are concerned about mold, and damage to our furniture, as well as the safety of our children, but we don't know if we can withold the payments, because that is what we would have to do in order to be able to move somewhere else. We were told that the inspector should be able to help us file a complaint, and it says that on the county website,but since he supposedly did the inspections he won't help us. We were also told to call the fire department and they could possibly condemn the house for fire hazard. I have tried going through Legal aid for my area but they said they aren't sure if they can "handle that kind of situation" and I just want be confident when I go to an attorney. There is much more, this has been kind of a cliffs notes version, and I do appreciate the feedback!
 
I strongly suggest that you seek the advice of an attorney as quickly as possible so you can stop the enforceability of this contract. Make sure you have the results of the independent inspector regarding the property before you go see him so he can see what is the best approach for your situation. Good Luck!
