My boyfriend and I were looking for an apartment in Ottawa, ontario preferably a sublet so we didn't have to come up with first and last all at once as you know that is a good chunk of money. I put an ad on a website and recieved a reply about a one bedroom to sublet for two months. We were going to pay the rent to the sub leaser at the end of the month and then two days after he had given me the keys something came up and I could no longer take the apartment. I left the apartment exactly how he had left it for me and, left the keys there for him. Everything was fine until today I received an email stating this ;

Hi Ashley,

So after speakin with my step father who is a lawyer you are legally obligated to pay me the months rent of sept. that we agreed on. We had a key exchange and you said I could come by at the end of the month to collect the rent. Since my friend was there and I have all these emails I could technically charge you for both months on the basis of that verbal agreement with the emails. I also had to pay two rents in September because you wanted to move in so I moved out.

I dont want to go to court and I dont want to sue anyone. I chose to believe your family emergency story so I don't want to have to serve you a subpoena . But Ashley you left garbage on the back porch which had chocolate milk in it. It all leaked out and had been sitting on that balcony since you left. It stained and Norberry is charging me 176.00$ something for that!!!!!!

Now I have no money for this and I'm really stressing. I am hoping you will offer to pay for that since that is clearly your fault and considering that fact that I will not pursuing this if you cover the damages. Can you please email me or call me? If I don't hear from you soon, I will have to serve you because I have no money right now tons of bills tons of debt and no one to help me out. I can't afford this one, I swallowed enough on this deal. I hope to hear back from you soon.

I too had a friend with me when we exchanged keys and still have all the emails if that helps at all. I never actually signed anything for the apartment which is why I thought it was ok that I had to leave after only two days of having the keys. I left no garbage on the porch to make this stain. I was wondering if what he is saying is right ?

You agreed to take the apt and you broke an agreement. You are likely on the hook because you prevented someone else from renting the apt. i would pay up or be sued. You cannot just break an agreement.
