My roomate decided to work for this guy for 2 weeks. He gave her a check for 3,600 in advance and she deposited it into her account and isnt going to do the work for him. She never signed any paper or they never had any kind of contract saying she would work for him. So I wanted to know is there anything he can legally do to get her in trouble or take her to court? She said they just sent a few emails back and forth and she thinks if she deletes her email account theres no way they can prove it was her writing those emails but i dont know I dont agree with what shes doing but I also dont want anything to happen to her since she is my roomate and I cant afford everything on my own.

Yah, the server will keep a record of everything, she can't just delete it.

She committed fraud. She should give back the money and say she can't do the work. Otherwise she can go to prison.
 
Not that it's worse than going to jail for fraud, but she could also expect to be sued for the return of the money.

Even if she deletes the account, he will still have copies of the emails. She would have to perjure herself by stating that she didn't write the emails. I don't believe that would work. Even if it DID, and it can't be proven that she agreed to work for him, she is left with trying to explain WHY he wrote this cheque for $3600 to her. "It was a gift" isn't gonna cut it. The legal term for A having something of B's with no good reason to have it is "unjust enrichment", and the court gives it back to B. (And, if A is really being an ass about it, as appears to be the case here, awards court costs against A on top of it.)

So she commits fraud and potentially perjures herself for what is ultimately going to be a lost cause anyways. I suggest she rethink her plan.
