Hi,
Im not sure if I'm in the right forum so I apologize if I'm not.
I co-signed on a student loan with Sally Mae for my ex daughter in law. She is not paying on it so they are coming after me. If I were to pay the loan off, would I then have the right to take her to court for repayment? How would I do that and would the courts be able to garnish her wages and tax returns?

Thank you

Yes, if you paid the loan off (let's say its $5,000), you could then sue her for the $5,000 you are out.

The problem is, she is a deadbeat.

If the government can't collect, you won't collect either.

But, you're free to try.

You'll get a judgment that one day might get you $25 or $30.

You can sue her in her state's small claims court.

You Google (YOUR COUNTY, UT small claims).

It'll all be explained before your very eyes.

You can then try to attach her wages.

The government won't do a dadgum thing for you.

You have to all the heavy lifting after you prevail.

No, you can't attach any income tax returns, unless you intercept them before they get to her back account.

But, don't get elated, that rarely happens.

You simply end up with some real pretty legal papers with seals all over them.

You rarely see any money.
