I am in need of advice and what my rights are. I did something rather foolish last month and authorized a transaction for a monthly listing on citysearch.com for one of my businesses. At the time I was told I would be charged a monthly of 10.00 plus any hit count charges, which were around 8.00 I think. I had (as most some people do) a hesitation about phone soliciting and if this truly was this company they said they were. They had gotten my information off of another site I am listed on and called me directly with this offer. There was $250. dollar cap a month for a listing...but I asked to clarifiy this and was told I would not be charged this amount, just the above two fees. I could not be charged more than the $250, but could be charged up to that, based on if I had that many hits to my page. That was part of what decided me-that was too much for someone to pay. They recorded my authorization for these charges to my credit card. I was asked if I agreed to terms and conditions (of citysearch)...which were-? I did not stop, nor have the time to now think about. There was no mention of a contract however, in this recording or in any of my conversations with the rep and in fact, I was only just trying this service out to see if it worked for me. I cancelled my listing three or four days later (I was unsure about this whole thing anyway, especially the hit count charges worried me.) When I cancelled (left a message) I said that I would pay the $9.99 in good faith but that I did not authorize any other charges. A big reason I cancelled was because I did not recieve any email or confirmations (just "You'll get an email soon") nor see my listing online or have any clue what was the next step to my signing up. I haven't even used the service.

They just called me. I told them I cancelled this listing a month ago- the manager fought me on it, playing back the recording. In that recording I heard how hesitant I was in saying "yes." I owe them $250 a month! Now they are saying they will come after me for $3,000, on this contract that I did not authorize, and not told about. The rep I talked to at the time said I could cancel at any time and I explained this- to no avail. I also spoke up for myself and said this whole thing was unfair and dishonest- to no avail. They have not called me back- as if it is my problem. I also got a rude awakening when they told me my email address: not the correct one I confirmed several times on the original call.


My stepfather is an attorney and I'm waiting to hear back from him. I also have a paralegal roomate who says they are at fault and cannot bind me, don't worry about it and I did not actually sign anything. Is there any advice on what my rights are and what I can do? :blush
