Lending a Friend Money

I lent a friend money $700.00 so that he could pay his rent for the month and some other things. I had lent him money and was paid back before so I did not think anything of it. He stated that he would pay it back 3 days later when he received his work check. Well of course he states he put it in my mailbox but when my mother when to look for it 1 minute later it was not there. He ignored my calls and text messages since that date until 3 weeks later when I received an email stating that he did put this money in my mailbox but did not know what happened to it. He then stated that he was still going to pay it back. Weeks later I still have not been paid back and am looking to take him to NYS Small Claims Court? Is this a valid reason? Will this be hard to do?

He put $700 cash in your mailbox? I don't believe it. Regardless, it was his duty to give you the money and he would bear the risk of loss. Take him to small claims court and have him swear under oath that he did what he said he did. I doubt any judge or arbitrator would believe that story. It's a simple process.

Other states allow you to file online. The process should be quick and easily able to be understood. The clerk can help you with the forms if you really need it. Good luck.
