I am a character witness in a custody case between my brother-in-law & a former best friend. I'm also employed as a phone sex operator. During cross examination, the opposing side's atty brought out personal information, as well as unauthorized reproduction of copyright protected content from my website, all totally irrelevant to either sides of the case, in front of my whole family. She also made me feel forced to read explicit content from my website in front of everyone present, which happened to be text that the webmaster had created for my site, not my own words. Can I do anything about this? I feel my privacy has been seriously violated, had any of it been relevant, I might feel different. This has been devasting. What can I do?
Also, the whole reason my website came to light, was that my former friend had knowledge of it. I had told her about prior to all the court sessions, etc, when she was still halfway sane. Prior to court, her husband had called and threatened me with calling the Dept. of Family services over the website, etc, if I offered any testimony at all towards my brother-in-law's case. Would I be able to prosecute her for slander/libel/defamation or copyright violation? Would her attorney possibly be held liable for copyright violation, in that, she made reproductions of the website content without any authorization? There are legal disclaimers, copyright, etc on every page of my site, all images/text on the site are also right-click protected. When they printed them out, they had edited all of the legal stuff out. Could I possibly have some type of case? This has wreaked havoc on my life. It was something private, that, otherwise, my immediate family would have never known about. I was called as the last witness, all witnesses prior to myself were my family members. They interrogated each of my family members about my website, asking them questions about it, and flashing my pictures (adult oriented from the website) around in court. I firmly believe that, had the legal disclaimers, etc not been edited out on the prints, that the judge would have been aware that everything was reproduced without authorization, and not allowed it into evidence. Afterall, the whole reason I was called as a witness was supposed to be to give testimony about my former friend's substance abuse and mental behavior to deem her fit or unfit to keep custody of the child she has with my brother-in-law.
