Lien extinguished in NH

New Member
Two months after filing a lien against a property for non-payment of association dues, I learned that foreclosure proceedings against that property were in progress. I'm also told that liens (other than those filed for tax purposes) against a foreclosed property in NH are extinguished; that the new owner is not responsible for lien payments. Where can I find that written 'law' or case or whatever so I can present this information to the other homeowners. As president of the association, I feel I owe them this much. Thank you.
 
You need to have a title company run a title report on the place after the foreclosure.

If your lien is prior (i.e., older) than the lien being foreclosed, then it may still be alive after the foreclosure.

If your lien is junior (i.e., younger) than the lien being foreclosed, then it will probably be killed in the foreclosure.
 
Thank you. However, I'm assured that, even though my lien is older, in New Hampshire, a foreclosure extinguishes all liens. Do you happen to know where I might find such a ruling?

Then New Hampshire is different than all other 49 states and all other US territories.

You need to have a title company run a title report on the place after the foreclosure.
