Lien, placed on home

:confused: My girlfriend and her brother live and own a home together.Her brother just told me that a letter he received yesterday said that a lien has been placed on their home .The lien is in her brothers name. He's been telling her that he was making payments to a collection agency.But he was lying to her. He made no payments.My question is :can they be forclosed on ? And does the lien affect her as well? And is it to late for her to set up a payment arrangment. Shes out of town on business and wont be back for a week.So Im trying to get some answers for her before she gets home because she is going to freak out when he tells her.:eek:

It depends on who placed the lien on the home as to the issue of forclosure.

The mortgage holder has superior rights in this matter, so unless the lien is for more than the mortgage, I doubt they'll lose the home.

But, the lien should be cured by paying it off, assuming the debt is valid.

All liens are not valid.

Some are placed by scammers.

She should investigate the matter, and if it is determined to be valid, pay it off if she wants to keep her interest in the home.
 
I would have to ask what the lien is for? WAIT A MINUTE, this just became clear! There is no lien on the house. This is some lying collection agency telling you there is a lien to scare you into paying. The only way there is a lien on the house is if the agency filed a lawsuit and won. Then there is a fi fa attached to the house.

If he has not been sued, there is no lien.
