I have received a notice from a state operated nursing facility that they will be placing a lien on the home that me and my wife jointly own - as a result of an outstanding balance that is in my mother's name. I have power of attorney to handle her financial affairs, my question is does having power of attorney make you responsible for another's party debt. I send the state all monthly income from my moms social security, and a retirement annuity but it does not cover all that is due. To be honest, I don't recall any language that stated that I would be responsible for any debt. Would love to hear opinions on this matter.

Did your mother previously own the home? Go in and talk to the business office to see why they feel they have the right to place the lein.

My mother has never had an interest in my home. The home she owned was sold 1-1/2 years prior to her being admitted to the state facility. She has no other property.
