My family has an interesting situation. There are 8 children. Our father passed away 4 weeks ago. He had life insurance through his present employer and didn't name a beneficiary. He also didn't have a will. So, it is the life insurance company's policy to name next of kin. Us 8 children. They paid the funeral expenses and then divided the rest. Now, this is the tricky part, he was in the middle of filing a Chapter 13 (or 11) bankruptcy. Other then this money, there isn't much of an estate. We spoke with an attorney and he said that the money we each recieved could have to be paid back to the estate. Is that true, or since we were named, are we free and clear in spending this money?
