Live in ex-boyfriend on the lease

Me and my ex-boyfriend are on a lease together at an apartment in Sacramento, CA. After we broke up he first agreed to move out and signed a document we wrote up to this affect. Now angered that we're not getting back together he won't leave. He won't let me sleep, leave me alone, I've missed work.
I wanted to quit the lease and move out and both pay half of the rent until the apartment is re-rented. I also had a friend that was going to finish the lease with me and replace him. He will not agree to either. The police came last night and he agreed to leave for the night. I pay all the rent on my own and the bills are all in my name. Is there any legal way I can evict him even though I don't own the apartment? Maybe by claiming a nuisance?
Please help. I cannot live with him, but also do not want an eviction on my record just becuase he refuses to leave (he cannot afford to live there as he is unemployed).

The problem you have is that each of you has a right to be there. Your remedy would be to sue him for half the rent and you may want to tell him that's what you're going to do (and perhaps he'll leave too.) Have you spoken to the landlord about removing his name from the lease?
