My rent check bounced. As soon as I was made aware of this by my bank I contacted my landlord about this. My first impression of the reason the check bounced was due to a problem with the bank or my direct deposit from my employer. I shared my perceptions with my landlord and advised her I could pay this check in full plus fees due in a couple of days. I just needed to get my bank account sorted out first.
My landlord subsequently asked for written, verifiable proof that the check's bouncing was not my fault. I said I would do my best to obtain that. Later that day my landlord left a letter detailing that I would need to pay the NSF check and fees in a money order/cashier's check as well as provide the written proof of the bank error or I would be evicted.
My question is I am paying the bad check and fees, can my landlord also require of me that I provide this bank information to her as well to avoid eviction? I am going over my account and I do now think it was my accounting error which caused the check to bounce. My first impression of the cause was incorrect. Can she evict me for failing to provide proof of a bank error? What difference does it ultimately make?
I need to note that in the past we have had problems paying rent on time but we have been on time the past 2 months. We had one other bounced check which was not for the entire amount due but only a portion of it but that was nine months ago.
We have a year lease, which is up in November.
