I recently worked for a sign company. I was brought in as a partner. There was nothing in writing stating that I was a partner in the company. I was brought in this way so he didn't have to pay income taxes, S.S., workman's comp., ect. I slowly became an employee rather than a partner and he is not taking out any taxes for me. He had put his son in charge of the company which not longer made me a partner, more of an employee.

Should I have to pay my own taxes if I was never really a partner for the company, but just an employee?

I was bringing in the skill of the trade and the other partner was backing it with money. I told him to start out with, I could not leave my current job to be there full time unless I was making what I was at my current job. He then called me and told me that he will give me a check every two weeks for what I am getting now without taking taxes out of my checks. After a few months I was starting to get accused of stealing. They claim that I was coming in late at night to print things to sell on the side. I had given some decals to a friend that had come in to help me with a job, instead of paying him money.

Can he have me arrested for this, if being a partner would mean that I would have 50% control over the company?

I gave my key to his son and told them that if they was having a trust issue that I would not be in the building unless they was there. They never let me back in the building again. I had brought personal items to the sign shop to use for jobs we had.

I had things like a digital camera, laptop, hard drives from pc's that I had from a previous job, that had person information on it like mine and my wifes SS#'s. The partner will not give any of my personal items back. He claims that I never had anything down there. He has told numerous people that he has now taken the pc from the company and my personal hard drives to where his wife works to have them gone through to see what I was trying to steal. His wife works for an internet company.

Can he legally take my personal hard drives to his wife's work place to have them looked at with out a court order?

Can he legally keep my other personal items too? I have receipts for some of the items but not all. I would have receipts for the hard drives form my personal computers.

He still owes me $1040.00 in back pay that he won't give me and I now am stuck with pay the back taxes on the money that I have received.

Should I be entitled to the money that is owed?

Sorry so long, but I wanted you to understand what was going on.
