Hi,

I work in sales and because of the economy; a few of my colleagues and I are not meeting sales goals. I was given a 'final warning' 3 wks ago saying that if I did not meet a specific (unreachable) goal, I would be terminated in Oct. Prior to this 'final warning', I had only received a 'coaching'. About a month before that I was told that my position was essentially being eliminated and that the department was going to be restructured. In the past month, salaried managers in my work place have been laid off, resigned or fired. Some of those positions have since been filled by part time, hourly employees. I get the feeling that they are trying to get rid of me anyway they can just so that they can save money and hire another part time person.

What should I do? I will have trouble finding another job once they find out that I was fired, especially in this economy. Will I be able to collect unemployment? Should I demand something in writing so that I know whether they fired me or laid me off?

You should always file for unemployment. "Failure to perform" is not a disqualifying reason for UI unless you could have performed up to standard and intentionally chose not to. Believe me, in this economy, the unemployment commissions have heard this hundreds, or maybe thousands, of times.
