Hello: I am trying to help a friend with his divorce and we found the forms but now we need help deciding which ones are the correct ones to file.

Divorce, Annulment or Separation

Complaints/Petitions for Divorce, Annulment or Separation

Complaint for Divorce: CJ-D 101. Mass. Probate and Family Court Department. "Use when one spouse wants a divorce." Use for contested divorce.

Joint Petition for Divorce Under GL c.208, s.1A: CJ-D 101A. Mass. Probate and Family Court Department. "Use when both spouses want a divorce claiming irretrievable breakdown of the marriage."

Complaint for Divorce Under GL c.208, s.1B: CJ-D 101B. Mass. Probate and Family Court Department. "Use when one spouse wants a divorce claiming irretrievable breakdown of the marriage."

Complaint for Annulment, CJ-D-100. Mass. Probate and Family Court Department. "Use to ask Court to declare the marriage between the parties null and void."

Complaint for Separate Support: CJ-D 102. Mass. Probate and Family Court Department. Use when one party seeks to be legally separated from his/her spouse, but does not wish to file for divorce.

Hello: Could you please tell me if the fee for a individual divorce includes the legal advertisement? It says the fee is $200 plus $15 but it does not say what it includes? How about the sherriff's fee to deliver the papers? Thanks, Meg

I don't know the exact costs required.

But, if you GUESS them to be about $400, you'll probably have enough.

You can call the court where you plan to file the documents and they will tell you the exact costs.

You can also file "in forma pauperis" (meaning you're indigent or without funds), and MOST courts will waive ALL or CERTAIN fees!
