Hi Yall,

So to begin, I have a crazy ex in my life. For the past four years she has been able to gain access to MY cell phone account. I have made several attempts to try and get the phone company to secure my account further. After numerous hours and point of contacts, needless to say they have failed, miserably. Because of this account manipulation, I have lost several jobs, my family have become victims to countless bogus texts, and ultimately has made my life a living hell.

I have concluded she was also able to cancel/suspend my account just from the call menu alone. I have a passcode on my account. and the fact she was able to do this even with it, baffles me. This is royally ruining my life.

My question is...Is there any legal action I can take against this Major corp.????

I suggest you attempt to do two things.

You can choose the order of your attempts, should you accept this mission.

One: contact the SECURITY department at the cell phone company. When you make contact, request to speak with a security agent or investigator. That might take a few polite rebuffs, and require you to request the agent/investigator contact you. It might be easier if you appear in person at a company store, speak with the store manager requesting her or him to assist you in contacting corparate security.

Two: report your allegations/suspicions to your local police department or sheriff's station.

Option Three, for extra credit, change cell phone providers. Don't tell anyone, especially the crazed beast.

One more long shot: seek a restraining order for stalking and/or harassment.

What does a restraining order do?
In general restraining orders can include:

Personal conduct orders
These are orders to stop specific acts against everyone named in the restraining order as a "protected person." Some of the things that the restrained person can be ordered to stop are:
Contacting, calling, or sending any messages (including e-mail);
Attacking, striking, or battering;
Stalking;
Threatening;
Sexually assaulting;
Harassing;
Destroying personal property; or
Disturbing the peace of the protected people.
Stay-away orders
These are orders to keep the restrained person a certain distance away (like 50 or 100 yards) from:
The protected person or persons;
Where the protected person lives;
His or her place of work;
His or her children's schools or places of child care;
His or her vehicle;
Other important places where he or she goes.

Civil harassment in CA:



In general, civil harassment is abuse, threats of abuse, STALKING, sexual assault, or serious harassment by someone you have not dated and do NOT have a close relationship with, like a neighbor, a roommate, or a friend (that you have never dated).

It is also civil harassment if the abuse is from a family member that is not included in the list under domestic violence. So, for example, if the abuse is from an uncle or aunt, a niece or nephew, or a cousin, it is considered civil harassment and NOT domestic violence.


The civil harassment laws say "harassment" is:

1-Unlawful violence, like assault or battery or stalking,
2-A credible (real) threat of violence,
3-The violence or threats seriously scare, annoy, or harass someone and there is no valid reason for it.
