Does the communication & making available right as stated in InfoSoc Art 3(1) & (2) also apply for computer programs - I can't find a similiar regulation in the Software Directive. The only solution I would see is that
a) for computer programs no such right exists (which seems irresponsible because especially computer programs are easily shareable through P2P or download links
b) the InfoSoc applies to Computer programs, too because there is no such regulation in the software directive
c) the distribution right (because defined broadly) in the Software Directive covers these rights somehow too
Maybe someone can bring light into this darkness for me!
