malpractice during a turp(transurethral resection of the prostate)

Hello,

My brother-in-law went through a TURP (transurethral resection of the prostate) surgery on 10/28/13 in Georgia because he had urinary discomfort and had to get up to urinate frequently during the night. The surgery had a side effect of retrograde ejaculation. In other words he became infertile. He and his wife were still trying to get pregnant. He is 56 and his wife is 46.

Is this a case for malpractice? Can he pursue a law suite against the surgeon?

Tell him to go see a local malpractice attorney.

He's old, unlike a 25 year old man, with an old wife, unlike a hot 22 year old wife.

That said, see what a couple local malpractice attorneys say, probably, no case, or not much of a case.

A bad outcome does not mean there was malpractice. Retrograde ejaculation is a well-known risk of TURP surgery; in fact some studies put the risk at 75%.
 
I was a life ins. underwriter (which included underwriting an applicant's medical history) - I agree/concur with Proserpina.

However, he can certainly talk to a medical malpractice attorney or two if he so desires. I "doubt" there is a case here.
 
Not only is he unlikely to have viable swimmers, she is unlikely to have viable huevos. This sounds more like someones imaginary retirement plan than a bona fide issue.
