I am a good friend of the person I will refer to as Joe. Joe is the man being taken to court by a woman he was with for sixteen or so years. he resides in a state where Common Law Marriage is not in effect.
Since the woman has lived in Joe's home although repeatedly asked to pay rent, utilities, etc., she never had money and always asked to barrow money from Joe.
Joe even worked a second full-time job for six years to get away from her.

Now sixteen years later, Joe, going on 50, told the woman, he wants her gone by his birthday or he will have her evicted. Joe drew up an eviction letter and gave her an option by drawing up another letter saying he would pay her a couple thousand dollars if she'd move her personal stuff as well as herself out by a certain date, she agreed and they both signed the paper.

A couple days before that date came, she needed money for a few things so Joe gave her what she asked for but also made addendum's to the letter misusing the money she needed. By the final date Joe came home from work to find finally her gone but all so a few thousand dollars of his things she had taken as well. He called the police. The police said they could have her arrested. Joe told them he owed her the balance of the amount agreed to on the letter but also told the police that he wouldn't pay her anything further until she returned his belongings. The police agreed.

Joe then text her telling her the position she has put him in. He told her to return his things and he's pay her the money. She denied taking his things. Then started threatening him she would take him to court for metal stress if he didn't pay her the balance.

The next thing you know he gets served at his work. The paper said she is taking him to court for mental stress and wants now $12000.

I do know that this woman has has time to learn the system. Joe found a lot of stuff on his computer about how to sue for mental stress. She has a public defender and has been going to state paid for psychiatrist for a couple years. Joe had a renter downstairs who can come to court to testify on his behalf as well as his own children who adore him. I know he has receipts for everything and that he and the woman have never shared a bank account or anything like that . He also bought her a used car because she said she couldn't get a job because she didn't have a car. There is so much more info he could compile if he knew what would help him in court.

I believe she has been planning this for a couple years. She once said to me, Joe promised he'd marry me but all he cares about is his kids and they'll get everything. This woman has 6 kids that all have issues. Anyway, can you give any advice. I think he should counter sue her. Is that possible?

I don't know why you think a public defender is going to be involved in a private lawsuit, but Joe would be wise to visit an attorney and talk to him/her/it about his concerns.

And in which court has this suit been filed? I'm not talking about location - I'm talking about small claims, superior, whatever.

She can't sue in small claims court in Va. for $12,000. ($5,000 max.) However; if Joe is being sued, he might want to talk to a lawyer.

This is a fairy tale.
There is no way a broken, down, old beggar could convince any licensed lawyer (or even a 3L at a law school clinic) to litigate this nonsense.
I'm wondering how Princess Brokendown got someone to serve her "lawsuit" on "Good Old Joe"?

Thank you everyone.
Joe went to court (hearing) on Tuesday. The Judge asked the woman why she thinks Joe owes her $12,000. She said that its for years of mental abuse and she began to babble nonsense. Joe told me he's yelled at her at times to get a job but I wouldn't call that mental abuse. The judge asked Joe if he owed her this money and he of course said no. Then the woman started in again and the I'm sure the judge felt it was way too much information so he set a trial date and that's where it is now. The trial is set for June. She claims to have no money so the state is supplying her with a lawyer.
If your crazy, which she is also claiming Joe has made her, would a crazy person know how to post on Facebook asking for donations to her cause? Yes, that is what she recently did. I'm trying to get a screen capture for Joe to take to court. Another thing, she's always had kids to live with, if she was being so mentally abused, why didn't she move out? I just don't want the system to hurt Joe. This woman has doen her research and I hope the system has seen women like her and see through her.

I know Joe wants this to be over but I think he should counter sue her if at all possible. There is so many things this woman has done and threatened Joe with that she need to pay for what she has put this man through.

Sorry, I misspelled a few things.
(Edited repeat)
Since she has no money, Social Services is supplying her with free lawyer.

Good friend, you're NOT "JOE", are you?
The reason I ask, we're ALL missing something.
Social services doesn't fund your lawyer.
If BEGGARELLA has opened a FUND ME ACCOUNT, while using a taxpayer funded attorney, that's what could be considered fraud. I've seen people prosecuted for that. One woman in my county did it six times in two years, until someone ratted her out!
Otherwise, the judge may have allowed the case to go forward to ensure BEGGARELLA gets her due process.
"JOE" needs to lawyer up, and STOP ADMITTING TO ANYTHING.
Smart defendants don't lie, they deny, deny, deny.
This case is a simple SHE SAID, HE SAID, if "JOE" learns to STOP YAPPING!
