I am a good friend of the person I will refer to as Joe. Joe is the man being taken to court by a woman he was with for sixteen or so years. he resides in a state where Common Law Marriage is not in effect.
Since the woman has lived in Joe's home although repeatedly asked to pay rent, utilities, etc., she never had money and always asked to barrow money from Joe.
Joe even worked a second full-time job for six years to get away from her.
Now sixteen years later, Joe, going on 50, told the woman, he wants her gone by his birthday or he will have her evicted. Joe drew up an eviction letter and gave her an option by drawing up another letter saying he would pay her a couple thousand dollars if she'd move her personal stuff as well as herself out by a certain date, she agreed and they both signed the paper.
A couple days before that date came, she needed money for a few things so Joe gave her what she asked for but also made addendum's to the letter misusing the money she needed. By the final date Joe came home from work to find finally her gone but all so a few thousand dollars of his things she had taken as well. He called the police. The police said they could have her arrested. Joe told them he owed her the balance of the amount agreed to on the letter but also told the police that he wouldn't pay her anything further until she returned his belongings. The police agreed.
Joe then text her telling her the position she has put him in. He told her to return his things and he's pay her the money. She denied taking his things. Then started threatening him she would take him to court for metal stress if he didn't pay her the balance.
The next thing you know he gets served at his work. The paper said she is taking him to court for mental stress and wants now $12000.
I do know that this woman has has time to learn the system. Joe found a lot of stuff on his computer about how to sue for mental stress. She has a public defender and has been going to state paid for psychiatrist for a couple years. Joe had a renter downstairs who can come to court to testify on his behalf as well as his own children who adore him. I know he has receipts for everything and that he and the woman have never shared a bank account or anything like that . He also bought her a used car because she said she couldn't get a job because she didn't have a car. There is so much more info he could compile if he knew what would help him in court.
I believe she has been planning this for a couple years. She once said to me, Joe promised he'd marry me but all he cares about is his kids and they'll get everything. This woman has 6 kids that all have issues. Anyway, can you give any advice. I think he should counter sue her. Is that possible?
