My manager at my workplace was demonstrating what she did to her nephew...and I happened to be closest to her and she grabbed me by my shirt with an open hand and hit me when she did, then she flung me back and forth....we have been having problems for a couple months cause she dont like me...I talked to my store manager and they are looking at the tape but he said because it was a demonstration and didnt have to do with work nothing would properly be done about it...what legal rights do I have? This isnt the first time she has put her hands on me.She has hit me and tried to trip me when I'm walking by also. I should not be afraid to go into work and I am. Thank you.

You could make a complaint to the police. She might be charged with a battery. Tell them about the tape.

If you gave her permission to demonstrate on you, you could be out of luck.

nope I was in window handing out food and I turned around and she did it...I wasnt part of their conversation...I went to police station and filed assault charges on her...I talked to the store manager and he acted like it was no big deal and said that ..She had no right to put her hands on me...I just want to know if I have anything I can do about it...quitting is not an option as I have 4 kids and am the only source of income...I am currently looking for another job but I think she should be fired but they proberly wont cuz my manager has no backbone and certain people get to do whatever they want...

Just sit back and let justice take its course.

You can now go to court and request a restraining order (peace bond) against her, stating she beat you and you fear for your safety.

Don't tell anyone you're doing this, just do it.

Keep your distance from this violent beast.

When the sheriff or constable come to serve the peace bond (or restraining order), all you have to do is watch the fun.

That'll shake things up, because she'll be ordered to keep 200, 300, maybe 500 feet away from you.

That makes it impossible for your employer to ignore what she has done.

That means she and you can't work on the same shift anymore.

In the interim, just keep your cool, and wait for the fun to start.

Here, take a look at this!
This discusses how to get a protective order (same thing) in Ohio!
It is for Columbus, but Google your city and/or county and see how and where you do it in your locale!

Good luck.

What are Protection Orders?

A Protection Order is granted by a Judge and orders the defendant to stay away from you. The defendant should not enter your home or approach you at your place of work or school. If the defendant violates the protection order, a new charge could be filed and the defendant could be arrested.

Although the Judge may grant the Protection Order, it does not guarantee your safety. It is important for you to be very careful and take steps to ensure your safety as much as possible. (See SAFETY HINTS)

The law (2919.27 and 3113.31 Ohio Revised Code) states that protection orders issued anywhere in the State of Ohio are enforceable throughout the state - if they are current and still valid. Comparable protection orders issued in other states may also be valid in Ohio.

Are all Protection Orders the same?

No. There are four different kinds of protection orders. Municipal (Criminal) court may issue a Domestic Violence Temporary Protection Order (DVTPO) or a Criminal Protection Order (CRPO) depending on the type of charge and your relationship to the defendant. Civil (Domestic) Court issues Civil Protection Orders (CPO) if you are a family or household member of the defendant. If you are being stalked, Common Pleas Court may issue a Civil Stalking or Sexually Orientated Offense Protection Order (SSOOPO).

Who can get a Criminal Protection Order?

If you are not considered a household or family member according to O.R.C. 2919.25, then you may request a Protection Order if any of the following charges are filed on your behalf.

- Felonious Assault
- Aggravated Assault
- Assault
- Aggravated Menacing
- Menacing by Stalking
- Menacing
- Aggravated Trespass
