Overtime is a function of Federal, not state law.

What are your job duties (it makes a difference) and how are you normally paid - by the hour or on salary?

at the moment it is physical labor such as drilling anchors into the ground for stability on a oil rig or gas rig and driving to each location. and i am paid by the hr

Based on the extremely limited information I have, I would agree that you should be paid at time and a half for any hours over 40. You are free to file a complaint with the DOL.
