I was initially pulled over for speeding, the officer then administered a couple of sobriety tests. After cuffing me and putting me in the back of his squad car he and another officer proceeded to search my car, he asked if there was anything I should know about in your car. I said, "they're may be a water pipe." The officer found the bong and less than a gram of marijuana. I have no clue where the marijuana was found in the car, and don't know how it got there. Perhaps someone who was riding in my car lost it at a past date and time. I also, don't remember giving the police the ok to search my car. The bong found was the tube only, without the loading slide. The possession charge of marijuana on the Uniform summons was 12:03 AM, later when they switched me out of my street clothes and into custody clothes they found a bag of marijuana in the pocket of my pants, which I don't beleive I was charged for since that was found around 3:00 AM. I know there's a difference in actually finding it on the person and finding it in one's car. If i didn't receive a summons for the second bag relating to the time it was found can this be held against me? Also, I can't find anything relating to the consequences of a paraphernalia charge on the internet.
Any and All advice is much appreciated.
