Marriage law and nationals

Actually, this is Both Mexico and Michigan, USA.


Long story short...

I have a friend who is Married to a US Citizen. However, since they've been married, he has provided no support financially, nor has he done anything to bring her stateside.

She wants a divorce and he is wanting to fight her on it.

She is a Mexico Citizen who was married to her husband in Michigan. Her Status expired and was forced to go back to Mexico.

She's been married to him for 3 years and he has been down to Mexico but went home two months ago and has done nothing to bring her stateside. Neither has he provided any financial support to her.

Basically, I was wondering under immigration law, what rights does she have as national married to a US citizen? Also, is there a way she can legally come stateside to take care of this problem?

As She is close to me and I am entertaining the idea of starting a life with her, it is imperative that we get this resolved. I know some states have abandonment laws. As he has effectively stranded her in Mexico and is offering no support of ANY kind, does she have any legal right in this situation?

Um.. I think I need to add. she's not wanting anything from him except to be rid of him. She doesn't want any money or anything. she just wants the ability to be with someone who actually cares.

She needs to consult with a Mexican attorney.
If she has any rights, they exist in Mexico.

She isn't in the US.
She has no standing to sue in US courts.
If she were able to return to Michigan, she MIGHT be able to bring a divorce action in Michigan.
As she can't enter the USA, she can't do it from Mexico.
She's in legal limbo, as far as this matter is concerned.
 
Thanks for the reply.. but as I said.. she want's nothing from him except her freedom... no money.. nothing.. just her freedom.

Okay. She's in Mexico.
She has to legally stay in Mexico.
Therefore, she should consult with a Mexican attorney.
She will probably be able to get a Mexican divorce.
I understand some Americans obtain them.
