Married to a man who never got divorced!

I am in the process of getting my things together to move out on a man who I married and afterwards, discovered that 10 years ago he was married and never got a divorce (and didn't tell me!).

I am a Canadian citizen living in the US on an H1-B visa and we were married in Canada.

How do I go about fixing this problem??!!! DO I get an annulment? Is my marriage void??? Please help!

You are not married (at least not to that guy) if your facts are correct, which means that your "marriage" is void.

What type of documentation or PROOF do I need that the marriage is void??? I can get a copy of his old marriage certificate. I do NOT want this to come back and hurt me if I ever want to get married in the future. THank you.

Then file for divorce; that will settle it for sure.

Check Canadian law online if possible and see if you can find anything. You really should consult with a Canadian attorney or an American attorney familiar with Canadian law to make sure there are no repercussions later on down the line ESPECIALLY concerning your Visa. It is illegal even in Canada to practice bigamy and there may be legal repercussions for this man and you if you don't handle this properly; so I do urge you to see an attorney as soon as possible to resolve this matter.
