The same Judge holding a position of power resided over a case of a friend, and his appeal. He is doing life without parole. It seems in many cases; as in almost all cases. A Jury is not preconditioned for sentencing of a death verdict. The question of life and parole, death, even life is very confusing and a question is always passed to the Judge for explanation. It seems they are universally told to not worry and decide on what they think it means. But, it seems there is an explantion. If aggravaters are present in crimes punishable by death, then the death penalty can be passed. All you need is at least one of eight aggravaters. The aggravaters must out weigh the mitigaters, or otherwise you cannot pass a death sentence. Tell me please, if there are no aggrevaters, how is life with no parole possible, is this not death sentence.

He did both? What kind of appeal was that?

I'm not sure that is an accurate statement of the law. But even assuming it is...

No, it's not. A death sentence is where they execute you. A life sentence without parole is where they keep you in jail until you die naturally. If, as you say, there were no aggravaters, and if, as you say, the jury cannot pass a death sentence unless there are no aggravaters, then the jury was not entitled to pass a death sentence. But there was nothing stopping them from passing a sentence of life without parole.

Was it really the jury that sentenced him? In Canada, juries only make findings of fact - guilt or innocence. They may make sentencing recommendations, but it is up to the judge to pass sentence.
