May a mentally incapacitated person make changes to their will?

If the caretakers of a woman with Alzheimer's pressured her to change her will to leave her property to them, would the attorney be to blame for permitting such a change, knowing that the woman was mentally incapacitated?

A person afflicted with Alzheimer's Disease isn't necessarily mentally incapacitated.

Mental incapacitation is a legal ruling determined after a hearing was held to allow a judge to make such a ruling.

The situation you described could be unusual, perhaps odd, but it doesn't necessitate one to infer it was illegal.

You might wish to discuss the entire situation with a CALIFORNIA licensed attorney in the Temecula area.

How do you know she was pressured? Just because she has Alzheimer's doesn't necessarily mean she was pressured or mentally incapacitated. That would be up to a court to decide.
