Me and my girlfriend moved into an apartment in may for a term of one year. both of our names are on the lease, and we both signed. Now it is october and she has become psychotic. i dont want to date her or, obviously, live with her anymore, but the lease doesnt end until may 2006. is there any way out of this?? if i leave the premises, can she sue me for half of the rent? can the landlord sue me? what are my options?

Either person can sue you, but they are required to mitigate their damages and try to find a replacement tenant. They also cannot double dip, which is find a tenant then go after you for breakingf the lease. I would see if the girlfriend here is willing to be reasonable and you might want to tell her to start looking for another roommate.

I would tell the LL of your intentions. Even if the LL does not go after you, the GF probably will.

what about this... in the lease, it states that the lease can be broken prior to the 1 year mark providing that the tenant give 60-days notice. the lanlord tells me that both of us have to consent to this. if i were to submit 60-days notice on my own, could the landlord still go after me? the lease says nothing about having to pay until a new tenant is found, it only states that i have to gove 60 days and that i lose the security. would the GF still be able to go after me for breaking the lease, even though i followed the leeter of the leasing agreement? I assume yes, but just curious...
