In August of 2005, I found a lump in my breast, and contacted a local agency for help because I had no medical insurance. I got on the Kansas Free-to-know program and ended up on medicaid to take care of some female problems that was found. I was scheduled for a hysterectomy in September of 2006 (over a year later), and was unable to complete it because my blood pressure was too high. A week later, my medicaid coverage ran out, and I was unable to reschedule the surgery because they said I wasnt qualified for medicaid anymore. (even tho I was unable to work at the time). Since then, I have developed Congestive Heart Failure, diabetes, severe Anemia, as well as some moderate memory loss, and vision loss.
I filed for disability in November, and with that i was put on Medi-Kan which is a form of Medicaid to help me through until the disability is approved or denied. Whichever the case might be.
I started bleeding heavy about mid november, and started seeing a doctor for it. I have had blackout spells, and other medical problems along with it. I have had three different doctors tell me it would be in my best interest to get a hysterectomy done because of all the fluid loss is causing other problems.
Today, I was finally re-scheduled for my hysterectomy, to be done two days from now. Because the doctor felt it was necessary to get it done immediately. I get a call from the doctors office this afternoon, and Medi-Kan will not cover the surgery and and Kansas Medicaid basically told me I was only on it temporarily, and I felt they were telling me I was SOL. (everyone knows that term).
My question is, if I can prove that my symptoms could have been prevented, is it possible to file a suit against the state of Kansas for denying me treatment on something that could possibly save my life, and/or allow me to go back to work, rather than continue with the disability claims?
I would rather not go to this extreme, but I feel that the state of Kansas has basically pushed me aside.
