Ok this is a long story I will try to shorten it. I recently went to the emergency for chest pains and numbness. I was kept overnight for more tests a whole lot of them. I was then released after a day was told I had an enlarge artery above the heart. I was then put on limited restrictions to return to work with limits do not lift more than 50-70 lbs. Also I will have this for the rest of my life. Now my employer said I can not return to work unless I have no restrictions and they put me on indefently medical leave with no pay. And they are only going to pay my medical benifits for another month.
What are my legal rights in this matter. And another situation is I work for my brother and sister-in-law.

How many employees does this employer have within 75 miles of your location?

How long have you worked for this employer?

In the 12 months immediately preceding your leave, did you work a minimum of 1,250 hours?

I worked 4 months I have not been back yet. I think the number of employees is about 50-60 or less

If you have only been there four months, you do not qualify for any protected medical leave (which would have been unpaid leave in any case).

That being the case, it is entirely up to your employer how much time to offer you. You do not have a legal right to medical leave, paid or unpaid, in this situation, and your employer is not obligated to allow you back to work without restrictions or to hold your job indefinitely. (Even if you were entitled to protected medical leave, it would not be indefinite.)

If you are in California, Rhode Island, New York, New Jersey, or Hawaii, the state offers disability benefits that you may be eligible for. If you are in any other state, it is up to your employer whether to provide disability benefits and if so, when you qualify.
