My relative was in a rehab hospital in Illinois. The patient had dnr marked on her original Healthcare poa, but cancelled it shortly after entering the hospital when she contracted an infection while under their care. She needed antibiotics, blood transfusions, and a heart monitor. At that time, The doctor told her and her agent, to cancell the dnr so they could provide those treatments, which they did.
Several weeks and several infections later,(while lying to her and to her Healthcare poa agent) (who is also her spouse), the hospital terminated antibiotic treatment and hydration against both of their wishes. The hospital also refused three requests by the agent to relocate the patient to another hospital for treatment. (also illegal) These things contributed to her death at age 60.
The patient had been estranged from her previous family for over seven years. She did not trust them and had very little contact with them. They contacted the hospital and insisted her care be discontinued against her wishes, as she was blind and they said she had "no quality of life". We believe they were somehow able to convince the hospital to go against her legal documentation.
The hospital insisted they did not terminate her care, so we hired a private autopsy. The autopsy results prove they lied and worse things that I won't reveal in this post. The patient would have "fully" recovered with proper care.
We retained an attorney, who took our money and did nothing except bill us for more. Other attorneys contacted have said, "these family matters can get ugly". The patient had legal documentation that was supposed to protect her from her previous family and malpractice, according to the law in the state of Illinois. In fact, Illinois law says the hospital is guilty of manslaughter. The problem is, finding an attorney that will enforce it. Any advice would be appreciated.
