I need help because i think this is totally blown up. I was walking out of meijer after buying $60 worth of stuff and was stopped by these two men in sweatshirts and jeans. They said come with us, and not knowing who they were i looked at them and said no. They didnt have a badge and threw me against the wall and grabbed me and i kept on saying that it hurt. I am a 110 lb girl, that wasnt necessary. They took me into the room and said she has them in her pockets, they looked in my pockets and found nothing. Heres the part im embarrassed about, the batteries fell from under my jacket and i didnt know they were in there. I had so many things in my hand i must have itched or something but if i were to steal i would have put them in my pockets or my purse. I denied it the whole time but he still made me get arrested for $9 batteries. He said he wouldnt have called the police if i didnt resist but i didnt and if they would have asked for them i would have gave them it if they would have gave me a chance to think. I think they were just bored and decided to handcuff me. I dont know whats going to happen besides my $90 fine considering i had to go the police station. Help!

What is your question?

i guess just whats going to happen to me? i had never even seen handcuffs before and the arrested me for $9 batteries and hurt me i think thats a little ridiculous

If convicted:

. Fines less than $500.00
. Community Service
. Probation
. Criminal record

You should look in Diversion as option discuss this with your Lawyer. You can also look into an Anti Shoplifter course Judges look fondly on this. My Husband has a contact within such a program. Contact me and I will see that you get that info if you wish

So ... theft should be okay if it is a theft of ... what? Under $25? Under $50? At what price level should it be legal to steal the item?

I do not believe you indicated your state. In California this could be charged as an infraction ... your state may vary.

Im not objecting to the fine because i can see why they would do that but to convict someone of that small amount that was unintentional and a first time offense... thats a little more than ridiculous

Your "intent" cannot be proved but fact you left store with unpaid for merchandise can. If you email me at address I gave you I can put you in touch with someone who can explain this to you

Okay ... YOU say it was an accident ... you wanna guess how many shoplifters say the same thing? Do you really believe the police should just take a suspect on his or her word?

If you fight it in court, I am sure that you can find an attorney that will argue that you did not have the intent and will attempt to raise reasonable doubt. It might cost you about $1,500 or more, but you can probably find an attorney that will make a good case for reasonable doubt based upon a lack of intent.

Good luck.
