Merchant never delivered goods

Hello,
I have ordered Canadian maple coins with a merchant over the phone. I live in California, but the merchant is OR.

The check (for an amount of $8300) was cleared on 8/20/2008. I was told that it may take up to 60 days for delivery due to huge demand in bullion market. I waited till 10/20 and the packet was not delivered. I contacted the merchant and on 10/28 , he sent an email to me that he delivered the packet. He never gave me tracking number even I sent him remainders several times. He was sending mails saying he is finding it out and the team is very busy... After waiting till 11/08, I called them again and I was told that it may take even longer to receive the packet.

Later, the merchant called me and said that the packet was sent to a wrong address and they will send it again.After couple of emails, they confrimed that they the packet was delivered on 11/17. They gave me a tracking number and told me due to huge volume of packets they send, it is not scanned in USPS and can not be tracked.

Even today, on 12/05, the packet is not received. They are not responding to my emails, not calling me or when I call , avoiding me.

I don't know what to do in this kind of situation. They are BBB accredited and that is the only reason I trusted them back in August.

What should I do? What are my legal rights? Am I protected legally?

I believe, they lied to me 2 times on my shipment and trying to buy some more time. More over, they are very RUDE on me when ever I call them. I am getting stressed out as the amount is huge and my job is also in jeopardy due to financial crisis in the country.

They sent you an $8,000 package without a certified method that can be tracked? That is hard to believe. Being a BBB accredited business doesn't mean they are honest - did you call up the BBB? I'd send this company a written letter stating the facts you wrote here and that their statement "it was delivered" is unacceptable. How can they know if there was no tracking method? What does it mean that the packet was sent to the wrong address - someone returned $8,000 worth of merchandise to them?

You may want to do more research on this company as well. Something doesn't quite sound bona fide.
