My daughter bought an Nintendo DS from a friend. It was supposed to be a new item but the one she received was used and the ac adapter is not the correct one (won't even plug into the player). She wants her money back. My daughter is 22 and her friend is 24 so they are adults in case that matters. She should have checked out the player before giving the money but since it was a friend she trusted him. Since we are talking only $120, is this too small for a small claims court? If we win would the looser be required to pay any filing fees or other court costs? Are there any other options that we have? We live in Plano Texas. Thanks.

you can sue.......However the cost(s) to do so could and more than likely will exceed the amount you are suing for. You can ask for court cost(s) as well, and you may want to consider punitive damages if the friend sold this item to you knowing full well the product was not complete, or defective.
