My jurisdiction is: Nampa, Idaho or New York, New York
Hey. I have a little predicament I was hoping someone can clarify. Any help would be greatly appreciated!
I met a girl on a video chat program. She lives in Nampa, Idaho and I live in New York City. We talked for about two months then decided to get together in person. She wanted to visit New York City. I agreed to let her come here and to stay with me for 5 days from Nov 9-13, 2008. We agreed to split the plane ticket costs ($300), she would be paying $175 and I would be paying $125 and I would also pay for food and activities while she was here. She didn't have a credit card, and she promised she would pay the $175 when she got here.
Two days before she came here, she informed me that she couldn't come up with the money. The tickets were already bought and paid for two weeks in advance and were not cancellable. She promised me that she would pay me after she got back home from the trip, and since we got along fairly well I thought she would be good for the money (she was having issues at work with not getting enough hours, so I tried to be understanding).
We had an good time for most of her visit, but on the last day we had a falling out. Basically she tried to sleep with one of my friends, and I was on the verge of kicking her out of the house. I decided against it, since I didn't want to have to call the cops because I was sure she would cause a scene if I tried to kick her out. When she got back home, she apologized for everything that happened and promised she would pay me back not only for the full price of the plane ticket, but for all of her food and activity fees, which add up to about $500.
Fast forward to about three weeks later, and she has not yet paid me back. She has also stated that she no longer has any intentions on paying me back. I have chat logs/screenshots of everything that was said between us, every time we discussed the split-ticket agreement and her promising to pay me back for everything including the food and activity costs later.
My questions:
(1) Do I have to file for small claims in Nampa or in New York?
(2) If I have to file in Nampa, do I have to file in person or can I file through the mail?
(3) If I have to file in Nampa, I'm hoping she wouldn't show up and I would get a default judgement. If she does show up, and I'm obligated to show up to plead my case, can I get reimbursed for travel expenses to Nampa?
(4) Does the evidence that I have (chat logs, verbal contract, text messages) have any credibility in court? The chat logs are screenshots of actual conversations and are as credible as online evidence is concerned.
