I am a full time student from Ohio. Upon entering U of Michigan stadium, I forgot that I had a can of beer (unopened) in my sweatshirt which a friend has asked me to hold for him earlier. I am 20 yrs of age. The friend was over 21. Nevertheless, after entering the gate at the stadium, a police officer asked what I had in my sweatshirt. I totally forgot I still had the beer! The officer confiscated the beer, which wasn't a problem, issued me an MIP and also confiscated my football game ticket/stub and told me to leave the stadium. Will I be required to appear in court? Or am I able to plead an admission of guilt and participate in the MIP diversion program without appearing in court? Does the diversion program consist of the $100 fine plus community service plus alcohol abuse program or is it any combination of those three? How do I fulfill these obligations living and going to school in Ohio? Final exams are in 2 weeks which is when a probable court appearance may be required. Any advice is appreciated.

First you have to appear in court in Michigan some district court only make you appear once but there are some make it twice (arraigment and sentencing) . And require you to meet with probation officer each month for 12 months . Community services around 35-50 hours . Random alcohol testing, they call you any time especially during upcoming holidays, you'll required to attend LEAP , MADD classes . The bottom line is it will cost you time and money . ( fines + court cost + classes + probation oversee fees each month = $600-1100) .
At the time of your sentencing, the procecutor will let you look at the police report before the judge come (this is your right you can ask for it on the same day) . Look at it and look at the recomment sentencing guideline near the bottom of the report . If you see there are too many things they make you go thru just bcuz holding a can of beer. Leveling with the judge so he can reduce your sentence . If you don't say anything he'll go along with the sentencing and make you travel back and forth . good luck and be polite with the judge. I know it sucks but they got you !!

I now get the fact that I will have to physically appear in court. But I have some questions about the other comments you made. Community Service hours? Where? I live in Ohio so do I fulfill these in Ohio and where? Do they tell me where or do I have a choice? Secondly, Alcohol testing? I'll be 21 in another month, so how/why can they test after I legally reach that age? LEAP/MADD classes - would an alcohol education class offered at my university fulfill this? And last, a probation officer located where? In Ohio? Michigan? Is that always the case to be required to see a probation officer? Thanks

Since you're in Ohio they might treat you different I don't know but for those folks who live in Michigan have to go thru some of these or all of them . Frankly I am not sure they might fine you, slap your risk and let you go . if that is the case you're lucky . Let me know how it come out I'm curious ok .
