My first visit here I hope this post isn't too long I tried to include as much info as possible to eliminate questions.
My good friend's dad purchased a used 1991 Mustang GT in 1993 from a car dealership. In 1995 he lost his job and filed bankruptcy. He told the Lein Holder he would voluntarily leave the car in his front yard by the road for reposession. There it sat for several years. Somewhere around 1998 - 99 He told me I could drive the car if I put insurance on it until it was repossessed if it was ever going to be; He was tired of it sitting in his yard. So I put a little money into the engine to get it back to better running condition. Year after year I registered the car in his name and his address while putting insurance on it in my wifes and my own name. We've had the car for almost 10 years now and my friends dad passed away this past fall. His house has been sold and his kids have moved away. He didn't leave the car to any of his kids in his will since it still has a lein and wasn't completley his. I was going to contact the lein holder and see if they would be willing to sell me the title to the car as I'd like to make a hobby car out of it and restore it. I heard from someone at work that after 10 years if the car hasn't been reposessed in Michigan the lein is removed and the title has been cleared. Is that hogwash or worth looking into? And if a lein still does exsist does anyone have any ideas on how I could find the lein holder's information to contact them? My friend doesn't want to sell me the car because it's not his and hes afraid he'd get hit with fraud or something of the like which sounds logical. Can I even donate the car to remove it from my yard if I'm unable to locate the lein holder or get the ttitle cleared?
Any advice or legal ingo you can offer is greatly appreciated.
