Middle School Question

Currently our middle school has a policy which allows parents to retain ("hold back") their child for any reason (size, age, maturity,etc..). But if they do so, that child is permitted to participate in every extra-curricular activity EXCEPT athletics.
Is this legal ?
How can they cherry-pick which activities the child can and cannot participate in ?
How is this fair to the child ?
 
seems logical, if your 13 year old is still in kindergarten, how is that fair to my 6 year old child? Perhaps your focus on sports is the problem? School is meant for academic exercise, yes?
 
There are athletics rules that apply to the various student leagues as well. This may be a way to combat what was happening in Texas many years back where families were holding a kid back for a year in high school so that he would be bigger and better by his senior year in high school.

Leagues can set rules to account for this and that may account for this exception.

And, yes, schools can generally set conditions for extra curricular activities. You can check your district's policies and the laws of your un-named state. And, if you feel it's worth the considerable expense, you can even consult an attorney to see if there is a cause of action against the school. i doubt it, but you never know.
