My wife and I are both active duty military on orders to leave Hawaii for our next duty station. We are in a lease that ends in Dec 09 and we are scheduled to leave in the spring of 09. We have given our landlord 90 notice and a copy of our orders. He says we have to stay until we physically leave. Do we have to stay or have we done everything required of us. Bottom line we are trying to move out prior to actually leaving the island because all of our possessions will be gone and we need to stay with friends in order to have a bed dishwear ect. Do we have to stay until we physically leave?

You've been more than generous in informing your landlord of your impending order to leave. Generally only a 30 day notice need be given along with a copy of the orders.

Your landlord is being unrealistic in expecting you to stay until the very last second when you must leave. Having rented to active duty military you have limited say in exactly when your furniture and belongings will be moved by the military.
