My son's father died in Kentucky. He is his only child. He has no will . We are divorced. What is my child's rights. There was some money . His father's parents said they were his beneficiary's. He ask about his fathers money and they said it was in there accounts which they did on the day he died . He ask them was they going to put it in a trust for him . And they said no . He would get it when he is 21 if they feel he deserves it. He is only 15 now. His father has not sent child support for 2 years because he has been sick that long. What should I do to get things set right for my son? He is a good child and his father loved him dearly.
 
did you apply for a social security survivors benefit? Was there an actual child support order? You can see an attorney to see if the child has any rights if the father died with much of an estate.
 
You can challange what ever he signed in court.

I don't know alot about probate, but I do know in most cases, a wife and/or child can not be excluded.

Your son should get something.
