My 17yo son go 2 tickets 28 days apart.
The first ticket was Business and Professions Code Minor Possessing Alcoholic beverage 25662 (a) B&P
In this case he was driving in a dirt lot. Kids in the back of the truck (in the bed of the truck) had beer. My son's car got stuck and the police came. When the police were approaching the kids in the back scattered in the hills taking the beer. My son stayed with his truck. The police called the kids to come back and they did but without the beer. The police spotted the beer and gave them all tickets.
If my son didn't drink, or hold, or even know about the beer can he still be convicted of minor in possession? The police never saw him with beer because he never drank or held it.
The next ticket 23225(A)(1)CVC
In this case his friends bought 2 beers and opened one in the car. The officer saw them leave the store. The officer went to the store and asked the worker what the kids bought and the worker told the officer what was bought. The officer got in his car, pulled my son over, and gave him the ticket.
I am thinking of fighting them both. The first one because my son had no knowledge of the alcohol nor did he ever even touch it. The second because my son didn't know his friends bought the alcohol.
I just don't want him to completely lose his license because he needs it for school, work, and physical therapy for an injury that he is healing from.
Does he have a chance?
Since he got 2 how much worse will it be ?
