Hello Everyone! My name is "C"and I am new to this forum. May 28th I was arrested outside of my house for shoplifting. I was caught running outside of Store name with a pair of 30$ headphones. I am on a surveillance camera inside of the store. When I was arrested I returned the items. I was very cooperative with the cop. My courth date is June the 14th. This is my very first offense. I don't want YDC. Probation and Community Service and fines I can deal with. I am 15 so a minor misdeameanor. I will be very respectuful with the judge and present myself as a responsible young man. What should I plead? What do you think my punishment will be? Is there a chance I may get YDC? Also, I failed to be marandized at any time by anyone.. I was indeed arrested and taken to the precint.. Isnt this a law that my rights be read to me? Can my case possibly be dismissed?

Lastly, my school record isnt very good either. Will this be a factor when the judge is deciding my fate?

Thanks,

Do not do anything without first talking to a lawyer. When you do ask if diversion is available in your case. Like many people they do not understand their Miranda rights. The only way miranda would apply is if you were questioned (by Police) after custodial arrest. If not mirandize then any statements made to Police (after custodial) arrest could not be used in court.

Ill have to settle for a free one. How would I go about getting a free autourney? Do I jsut go to the court and see if they have one?

When you face Judge you either plead not guilty or enter no plea and request Public defender. Rules might vary since your a minor so call courthouse. However since many Attorneys offer free consultations I suggest you get as many as possible
